This inadmissibility or dismissal of claims, particularly in actions for restitution of reciprocal considerations (Replevin lawsuit to recover goods), creates a presumption that such claims are automatically barred. Although the legislature has explicitly stipulated that the conditions for restitution must be verified in replevin lawsuit cases, the supremacy of the right to legal recourse (<em>right to action</em>) over all procedural and substantive aspects necessitates an interpretation whereby even the inadmissibility of claims remains contingent upon: Verification of applicability – Whether the 2024 Law governs the transaction in question; and Proper implementation – Whether the registration system was correctly enforced. Thus, the inadmissibility under this law should be construed as a substantive ruling (on merit). While primarily serving as a judicial oversight mechanism to ensure: Proper functioning of the registration system, and Compliance with statutory requirements, it remains subject to judicial review at higher courts upon request by an interested party. در قانون الزام به ثبت رسمی معاملات اموال غیرمنقول کوشش شده، درباره معاملات اموال غیرمنقولی که در سامانه مخصوص ثبت نشده‌اند، در حالی که باید می‌شدند، نوعی رهیافت برگزیده شود که برابر آن، دعاوی راجع به این معاملات مسموع نباشد. مسموع نبودن یا رد دعوا در دعوای استرداد عوضین، این تلقی را پدید می‌آورد که این دعاوی خود به خود مسموع نیستند یا مردود هستند. گرچه در دعوای استرداد عوضین قانونگذار به لزوم احراز شرایط استرداد تصریح کرده، به باور نگارنده برتری اصل حق دادخواهی بر همه شئون و فرایند‌ها ایجاب می‌کند تا نظری پذیرفته شود که بر بنیاد آن حتی مسموع نبودن دعاوی، مستلزم احراز شرایط شمول قانون سال ۱۴۰۳ بر معامله و درستی اجرای آن باشد. بر این اساس، مسموع نبودن موضوع این قانون را باید، رایی ماهیتی دانست که خود گرچه برای نظارت قضایی بر عملکرد سامانه و شرایط تحقق قانون است، می‌تواند به درخواست ذینفع در دادگاه‌های بالاتر موضوع بازنگری قضایی بیشتر باشد. https://www.sabtjournal.ir/article_727617_648a80ec5d7d18039af463b905409611.pdf
