Although evidence of this notion can perhaps be found among some jurists, most jurists have passed over it with detailed critical arguments. In this article, by addressing three topics: the requirement of verbal formula in contracts, the analysis of the requirement of past-tense (māḍawiyya) in contracts, and the issue of conformity and order of offer and acceptance, an attempt has been made to clarify the basis of the opinions of early jurists and to analyze the views of later jurists that have been organized on the same foundation. This article demonstrates that what has been central and foundational in juristic analyses is merely the clear and undeniable expression of intent; otherwise, from the perspective of juristic evidence, there is no reason for the necessity of using a specific form for the validation of a contract. At the end of this article, it is also briefly addressed that the registration of important and valuable contracts can be considered necessary based on the principle of rational construction, and accordingly, if social conditions change and new technologies emerge, it may be possible to move beyond this stage. معروف شده است که فقهای شیعه احتمالا با الهام از حقوق رم، اصالت شکل و فرمالیسم را در عقود پذیرفته و استفاده از الفاظ خاص را برای هر عقد، جزء ماهیت عقد تلقی نموده‌اند. اگرچه شاید بتوان شواهدی دال بر وجود این انگاره بین برخی فقهای یافت اما اکثر فقها با طرح استدلالی انتقادات مفصل از این اندیشه گذر کرده‌اند. در این مقاله با طرح سه موضوع اشتراط صیغه لفظی در قراردادها، تحلیل اشتراط ماضویت در عقود و مسئله تطابق و ترتیب ایجاب و قبول تلاش شده است ضمن ارائه نظرات فقهای سلف، مبنای نظر ایشان روشن شده و نظرات فقهای متاخر را که بر همان اساس سامان یافته است تحلیل شود. در این مقاله نشان داده شده است که آنچه محور و مبنای تحلیل‌های فقهی بوده صرفاً بیان قصد به نحو روشن و غیرقابل خدشه بوده است والا از منظر ادله فقاهتی دلیلی بر ضرورت استفاده از شکل خاص برای تحقق عقد وجود ندارد. در پایان این مقاله نیز به صورت مختصر به این مسئله پرداخته شده است که ثبت قراردادهای مهم و باارزش را می‌توان با استناد به دلیل بنای عقلا، ضروری انگاشت و به تبع در صورت تغییر شرایط جامعه و ظهور فناوری‌های نوین می‌توان از این مرحله نیز گذر کرد. https://www.sabtjournal.ir/article_727987_0def63fd85fde4f47a816e0a068e97a8.pdf
