Transactions conducted through private deeds, due to lack of oversight and the potential for forgery and misuse, have provided a convenient environment for commission of crimes such as document forgery, fraudulent transfers, adverse transactions, money laundering, and tax evasion. As a response to these challenges, the legislature, aiming to enhance legal transparency and security, enacted the Law on the Requirement to Register Real Estate Transaction in 2024.
One of the main objectives of this law is crime prevention. This study adopts a descriptive-analytical approach to examine the preventive capacities of this law. The findings reveal that granting exclusive validity to notarial deeds—through transparency of processes, electronic registration, and transaction traceability has significantly reduced the opportunity for traditional crimes such as forgery, fraudulent transfers, and adverse transactions, and in some cases, money laundering. However, despite these preventive functions, if proper measures are not taken in designing the registration systems, failure to continuous oversight of their implementation, and adopting relevant technical bylaws, there will be a risk that traditional crimes may shift into modern forms within the system’s framework or even arise from the law itself. Therefore, this study focuses both on the preventive functions of the law and the potential emergence of new forms of criminal conduct within the system’s framework or the law itself.
